CBS Defends Boob Tube In Court
Network challenges FCC's $550,000 fine

LOS ANGELES, CA  [Monday Nov.27.2006]  /WMQT.com/ -- CBS is denying any wrongdoing in the 2004 Super Bowl 'Nipplegate' incident, and has taken the case to court.

The network is challenging the $550,000 FCC fine on the grounds that they were unaware of any plans to have Janet Jackson's breast exposed, and therefore not responsible.

In a 76 page brief, CBS stated that the incident consisted of an "unscripted, unauthorized and unintended long-distance shot of Ms. Jackson's breast for nine-sixteenths of one second," and that the actual broadcast was "neither explicit nor graphic."

The brief also stated that Janet and Justin Timberlake "independently and clandestinely devised the finale."
